by accessing our website or placing an order with us, you agree to be bound by the following Terms of Service. Please read them carefully prior to making a purchase.

General:

By using this website and placing an order, you agree to these Terms of Service. We reserve the right to amend or update these terms at any time without prior notice. Continued use of our website following any changes constitutes acceptance of the updated terms.

Handmade Products:

Our products are lovingly handmade. Due to the handmade nature of our items, slight variations in fabric placement, pattern alignment, sizing, stitching and finishing may occur. These variations are normal and make each item unique. They are not considered faults or defects.

Product colours may vary slightly depending on your screen and device settings.

Orders:

All orders are subject to acceptance and availability.

By placing an order, you confirm that all information provided, including your shipping address and contact details, are accurate. The Custom Witch Co is not responsible for delays or losses resulting from incorrect information supplied at checkout.

The Custom Witch Co reserve the right to refuse or cancel any order due to;

  • Pricing or listing errors
  • Product availability
  • Suspected fraudulent activity
  • Abuse or online bullying
  • Any other circumstance that makes fulfilling the order impractical 

PRICES:

All prices are listed in Australian Dollars (AUD).

Prices are subject to change without notice. Any price changes will not affect orders that have already been placed and paid for.

Discount codes, promotions, and sales cannot be applied retrospectively to previous purchases.

PAYMENT:

Payment is required in full before any order will be processed or production begins.

We accept the payment methods displayed at checkout.

POSTAGE:

Postage costs are shown at checkout. Please note that there are tiered postage options pending what you are purchasing. Please select the correct postage tier to prevent any delays or unexpected invoices for unpaid postage.

Once your order has been lodged with Australia Post, delivery times are outside of our control.

The Custom Witch Co are not responsible for delays caused by:

  • Australia Post or other courier services
  • Customs processing
  • Weather events
  • Natural disasters
  • Public holidays
  • Any other circumstances beyond our control

Tracking information will be provided, and a shipping notification will be sent to the email address that you checked out with.

International customers are responsible for any customs duties, taxes, import fees or any other charges imposed by their country.

RETURNS, REFUNDS & EXCHANGES:

Nothing in these Terms of Service limits or excludes your rights under the Australian Consumer Law.

PRODUCT CARE:

Customers are responsible for following care instructions supplied with each product.

Damage caused by incorrect washing, drying, ironing, misuse, neglect, accidental damage, or general wear and tear is not considered a manufacturing fault and is not eligible for a refund or replacement.

Please refer to our Product Care Guide on the website for all care information.

FABRIC/DESIGN PLACEMENT:

Bows are individually hand cut, meaning pattern placement will vary between products.

No two items will be identical, and pattern placement shown in listing photographs cannot be guaranteed.

INTELLECTUAL PROPERTY:

All contents on this website, including but not limited to:

  • Product designs
  • Photographs
  • Logos
  • Artwork (unless specified)
  • Product descriptions
  • Website content

is the intellectual property of The Custom Witch Co and may not be copied, reproduced, distrubuted, or used without prior written permission.

LIMITATION OF LIABILITY:

To the fullest extent permitted by Australian Law, The Custom Witch Co shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of our products or website.

Our liability is limited to the amount paid for the relevant product where permitted by law.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights provided under The Australian Consumer Law.
